Terms of Service
The agreement between you and Businessily, written in plain English. These terms cover how the free service works, what you're responsible for, and the honest limits of what we can promise. Please read them.
Effective date: June 2, 2026
This document is a general, plain-English template provided in good faith. It is not legal advice, and it has not been tailored to your specific situation. If you have questions about how these terms apply to you, please consult a qualified attorney.
1. Acceptance of these terms
Businessily ("Businessily," "we," "us," or "our") provides a business-management application for solopreneurs, freelancers, and small teams. By creating an account, opening the web app at businessily.app, or otherwise using the service, you agree to these Terms of Service. If you do not agree, please do not use the service.
These terms work alongside our Privacy Policy, which explains what data we do and do not store. Together they form the full agreement between you and Businessily.
2. What the service is
Businessily is a free business-management app. Core features — invoicing, expense and income tracking, mileage logging, 1099 and W-2 tax preparation, scheduling, and bookkeeping — are provided at no charge, with no credit card required, no ads, and no selling of your data.
The web app is live today. Native apps for iPhone, iPad, Mac, and Android are coming soon. You can read more about what's included on our features page, how your data is handled on our security and architecture page, and why the app is free on our pricing page.
We may add, change, or remove features over time. Some optional power-features (for example, accepting card payments through your own Stripe account) may be introduced in the future and could carry a fee; the essential features described above are intended to stay free.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use Businessily. The service is intended for business and professional use by people and organizations in the United States. While you may be able to access it from elsewhere, the app's tax features, IRS rates, and legal templates are built for US use, and we make no claim that they're appropriate outside the United States.
4. Your account and your data
You can start anonymously. If you choose to secure your account with an email magic-link or a password, you're responsible for keeping your login credentials safe and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.
You own your data, and you are responsible for it — including its accuracy and completeness. Businessily organizes, calculates, and exports the information you enter, but it cannot verify that what you enter is correct. Double-check your records, especially anything you rely on for filings or payments.
You can export your data and you can delete your account and its data at any time. See our Privacy Policy for details on how that works.
5. Acceptable use
You agree to use Businessily lawfully and reasonably. In particular, you agree not to:
- use the service for any illegal purpose, or to store or transmit unlawful content;
- attempt to access another user's data, accounts, or rows you are not authorized to see;
- probe, scan, overload, or disrupt the service or its infrastructure;
- reverse-engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law;
- resell, sublicense, or misrepresent the service as your own; or
- use the service in a way that infringes someone else's rights or violates applicable law.
We may suspend or end access that we reasonably believe violates these rules or puts the service or other users at risk.
6. Important: Businessily is software, not advice
Businessily is a tool. It is not tax, legal, accounting, or financial advice, and using it does not create a professional-client relationship of any kind. Tax estimates, deduction suggestions, mileage rates, and generated forms are provided for your convenience and information only. They may not reflect your complete situation or the most current rules.
You are solely responsible for your tax filings, financial decisions, and legal obligations. Before you file anything or make a decision with financial or legal consequences, review the results yourself and, where appropriate, consult a qualified accountant, tax professional, or attorney. We do not guarantee that any calculation or output is accurate, complete, or suitable for your purposes.
7. Third-party services
Some features rely on services run by other companies — for example, Stripe (for optional card payments through your own connected account), Google (for two-way calendar sync), Apple (for on-device storage and iCloud sync on Apple devices), and our cloud and hosting providers. When you use those features, you're also subject to the relevant third party's own terms and privacy policies. Businessily isn't responsible for the practices, availability, or actions of those third parties. Notably, money from card payments goes directly to your own Stripe account; Businessily never holds your funds and never stores your Stripe secret keys.
8. Intellectual property
Businessily — including its software, design, branding, and content (other than your data) — belongs to us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the service for its intended purpose under these terms. We don't claim ownership of the business data you enter; that stays yours.
9. The service is provided "as is"
Businessily is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that any output will meet your needs or be free of mistakes.
We're an independent, bootstrapped, and early-stage product. We work hard to keep things reliable and private — you can read exactly how on our security page — but we cannot promise perfection. Keep your own copies of anything important by using the export tools.
10. Limitation of liability
To the fullest extent permitted by law, Businessily and the people behind it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the service — even if we've been advised such damages were possible.
Because Businessily is offered free of charge, to the fullest extent permitted by law our total liability to you for any claim relating to the service will not exceed one hundred U.S. dollars (US $100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
11. Indemnity
You agree to defend and hold harmless Businessily from reasonable claims, losses, and expenses that arise from your misuse of the service, your violation of these terms, or your infringement of someone else's rights. We'll let you know if such a claim comes up.
12. Termination
You can stop using Businessily at any time, and you can export and delete your data and account whenever you like. We may suspend or end your access if you materially violate these terms or if we need to for legal, security, or operational reasons. We may also discontinue the service or any feature; if we do, we'll aim to give reasonable notice and a chance to export your data. Sections that by their nature should survive termination — such as intellectual property, disclaimers, limitation of liability, and indemnity — will continue to apply.
13. Changes to the service and these terms
We may update these terms from time to time as the product evolves or as the law requires. When we make a material change, we'll update the effective date above and, where reasonable, give notice in the app or by email. Your continued use of Businessily after a change takes effect means you accept the updated terms. If you don't agree, please stop using the service and, if you wish, delete your account.
14. Governing law
These terms are governed by the laws of the United States and the state in which Businessily is established, without regard to conflict-of-laws principles. Any dispute will be handled in the courts located there, unless applicable law requires otherwise. If any part of these terms is found unenforceable, the rest stays in effect.
